I got a ticket for window tint tues. from state trooper. He stopped me because passed another car legally and?
after checking credentials had no reason to have pulled me over. So he went and got machine to check tint. In Al. legal is 32% mine read 16% told me to remove prior to ct. date and it would be dismissed. Issue is my dependent son and self have a rare eye disorder making eyes very light sensitive, his MUCH worse than mine, and since he doesn't drive at present he is always in my car. He received flash burns last wk. and we've been at ophthalmologist almost daily and I asked the Dr. if she felt this % of tint was necessary a good bit of time and she said her opinion was it was and she'd write the court to explain. NO I don't want to remove it I can't tolerate sun as it is but the next legal % is 20 mirrored, so do I take a risk and present letter or replace so I don't get points on my record? Anyone with law connections or own experience Please help!!!!!!
As long as the letter is from a real ophthalmologist (not a GP or optometrist) and states things clearly I would risk it and give it to the judge. Judges believe experts. I would suggest that the doc include her opinion on the fact that you can see clearly, even at night, with the tint.
Since Alabama allows some tint it does not appear to be an officer safety thing, like it is in some northern states, but a driving safety law.
I would also check the exact wording of the law to see if there are exceptions allowed.
Unless it is albinism, so your skin not just your eyes have light trouble, I also suggest you consult your doc about tinted contacts.
